Hi Team,
I have a few things to update you on.
The site has been down today because the host says the draw
on our database is somehow crashing the mysql server.
Therefore we have to move to something bigger.
They said we are averaging 100,000 hits per day and between
our software that is sending out emails and the recruiting
stats etc, is just to much for what we have going.
So it is being moved as we speak and may take a couple days
for the domain name to point to the right place.
That being said, I also have some news from speaking to
an attorney.
It is not good news either.
This is an attorney that specializes in mlm.
According to him, there is no definate answer to whether
something is legal or illegal.
It is basically a series of things that must be in place.
It is also a series of registrations in each state etc.
Each state is different in their laws, so this makes it even more
difficult.
However, his advice was to not open this program because of the following reason which is just one hurdle we would have to jump
before doing anything else as far as being legal.
According to him judges tend to follow a rule of a ceratin percentage
of retail sales being sold to customers that have nothing to do
with the program itself.
According to him this rule could be 70% retail sales.
The attorneys want to see at least 51% before going any further
and looking at other things in our program.
According to them the judges look for this rule of thumb right away
and ours would send up a big red flag.
This is basically for any multilevel pay plan.
The matrix itself is not illegal.
Unfortunately there is no way we could achieve 51% anytime soon.
What are we going to do?
Well we have to go back to the drawing board.
We will however open up the traffic exchange without a payplan
and it will be a free exchange for you to use.
Those that have recruited will keep those referrals for the
new structure we come up with whether it is for credits or
commissions on upgrades or anything else.
As you can imagine this has not been a good day for any of us
including all of you.
Right now all I can tell you is that the traffic exchange will
be different than you are used to seeing.
We will be changing the website to reflect this change.
If anyone wants removed just email me your id#.
Also their have been reports that some of you are using splash
pages that have guaranteed earnings or get rich type stuff
on them. Please do not do this. We all have a page to advertise
with. If you are going to have your own page then read the
website first and tell the truth on your splash page.
Nobody is going to make a ton of money somewhere in a short time.
That is rediculous.
Just use your heads.
I would hold off making any pages until the site changes to reflect
what we will be doing.
To those that may be upset or depressed about this I appologize.
I too am not happy. However I am now glad that we did not accept
payments at all until we knew for sure.
A lot has went into this, more than most of you will ever know.
Money, time, etc.
But what we still have is a team. If anyone doubts that then
look at what started out with a team of just 500 people.
500 people made this program recognized by many.
I have and always will look out for the best interest of this team.
There are not many teams on the net that could do what we have done here in 4 weeks.
So to those that are thinking of quitting, think about what is
possible with the right program with this team.
To this day I remember having about 18 members.
Those 18 made a team and never looked back.
The traffic exchange we will have will be geared toward continuing
to build this team. One day we will get the right program.
Until then we will use the traffic exchange to build it for free.
I will update as I know more.

Actually for me, the Traffic exchange is what attracted me to POAD
in the first place. The idea that visitors will actually be reading what your
website has to say instead of worrying about how many credits they
can earn as fast as they can. The matrix was just a bonus! I'm sorry
that the lawyers shot it down but it's better to find this out now when
something can be done to change it, rather than to have your ISP/host shut
your whole domain down without warning after the program has been established. (I was in a program that this happened, and it was devastating to the 10,000 members who was involved!) and the sad thing was that the program wasn't what we were accused of and shut down for, and there wasn't anything the admin could do to convince them otherwise. So yes it it a good thing that no money from the members has been paid yet. I think that the majority of the membership here will stay and support whatever decision you make where POAD and the members are concerned! _________________ To Our Success...

What if the 70% retail sales came from subscribing to a "newsletter?
Such as the updates that you provide to us, and monies "earned", would come from YOU giving back to your "loyal Subscribers"; only, you would disribute the funds from a members "POOL"

to have kept them legal.

So what if the traffic exchange was sold as just that, a monthly fee for advertising. Then the payments came from clicking ads, much like a Paid to Click program with multiple referral levels. There are lots of those running now, in fact I'm in a couple myself.
All I want to see is a good exchange that gets ads read and a way to make back my investment it costs me to subscribe. I can get rich on my other stuff if I get good advertising so people read my ideas instead of madly clicking with glazed eyeballs like some zombie. _________________

Thanks for the update, Joseph. You truly are a great leader. Honestly, I am disappointed with this new development. I won't deny that. However, for me, this is just one of the obstacles we have to face as a team. I believe that the more negative things that we experience the more stronger our team will become. Let us just work together and focus on our goals and i'm sure that we will be building the greatest team in the internet history!

I too am sad, that we could not move forward as we all thought! But, I am confident that together we will all achieve more. I believe in POAD, and just the fact that we have been experiencing alot of adversity means we are on the right track. Diamonds are made from a lump of coal and giant oak trees take years to grow, so we will regroup and continue to be the most cohesive team on the net.

What about this?? Are all the other progams we want to join EAT, xstream etc legal if so can't we use the POAD TE as a free feeder. Continue with the launch on the 1st but cancel the payment and payplan...Then when an individual has say a downline of 50 or whatever they are invited to join the paid programs. Obviously the idea being that if they have a big free downline they will have a small paid downline I know some of the matices are different but at least people would be break even at least. This is a bit on trust that people once invited will pay up but we can then put a time limit to pay up on it also if someone has a big free downline liklihood is they'll pay up especially if the 1st paying prog is a one time payment like EAT is or was?? Plus this way the programmer doesn't really have to make that many changes?? not that I have the faintest idea waht is involved. I hope this make sense to someone! I am rambling a bit but having read Joseph post I was a bit gutted and surely we can salvage something from this we were just getting going...100,000 hits thats too good to let go plus from reading the forum every day I know how much people have put into this plus we have a lot of brain power going on !!

Thanks for all you are doing. I am not a quitter and will be there till you say no more.
What I would like to ask is Is the FREE MATRIX going ahead now then are you still transferring us to that in August.
I am glad you are making sure everything is legal and above board that way we can hold our heads high knowing this is an honest matrix with a team with nothing to worry about.

Thank you for your update and what it means. I appreciate honesty in a scenario and I know that it must have been hard to face the facts. I'm with this team for whatever that may be worth to any of you. As someone else pointed out, I was actually more drawn to the fact that people would actually READ my program in a traffic exchange rather than the income opportunity. That idea has a lot of merit just by itself.
I, too, am sorry that we have been halted again, but better now than being shut down later.
I thank you, Joseph, for all the hard, hard work you have put in behind the scenes getting POAD up and running and keeping it going. Today was just a bump in the road.
It's been about a year now, since my first phone conversation with Joseph and I knew before the call was over that he was a man of integrity, honest and trustworthy. I'm proud to be part of this amazing TEAM and I'll be here until that proverbial place freezes over.
